Yikes! Law Suit includes my Tavern on the Green Mural
by on 1/5/2010 12:58:14 PM

The photo above and the quote below are taken from the following on line article in the Bloomberg News.  http://www.bloomberg.com/apps/news?pid=20601088&sid=aIn1uUVYKnfI

"The parks department said in an objection to the auction that it has a right to items including the wood paneling, custom plaster ceilings in the Crystal and Terrace rooms and a 19th- century Central Park scene by Lillian Kennedy.

The items “have become affixed to the premises and cannot be removed without irreparably damaging the space they occupy,” parks department lawyers wrote. Under a 1985 licensing agreement with the agency, any items considered “fixed equipment” belong to the city and not the restaurant, the lawyers said."

Tavern on the Green Auction in New York City- “Hey, that’s MY mural, yes THAT one, the one of Central Park with over a hundred horses!”

Any parent who has ever jumped up, waved their arms and wanted to shout from the bleachers, “That’s my kid!” will know how I am feeling.  The child, especially if an adolescent, will probably be embarrassed.   That’s the relationship that I have with my beloved Tavern on the Green mural. It will be sold off to the highest bidder and go to a new home – my own offspring – without any parental input. I want to go and shout out from the sidelines - but the hitch is, it isn’t mine.

How do you handle your relationships with your artwork once you no longer possess it? Do you hover over old photos now and then? To you ever want to meddle with its current life?

I've seen better pictures of this fabulous mural of Central Park when watching Burt Wolf's travel show on TV once. All at once there he was showing Tavern on the Green and really focusing on the mural. What a thrill. Wonder why Guernsey's Auction House does not show more and better photos of the mural. They get 22 percent buyers premium or I think that is what I read. In our area auction houses get 20 percent seller's commission AND 10 percent buyers commission. Now 22 percent sounds high. Certainly high enough to mention something like it being on Burt Wolf's show and more about the impressive background of the artist Lillian Kennedy. The estimate also sounds WAY low but maybe that is because, again, time was not put into researching the artists background. Didn't a Lillian Kennedy small giclee go for several thousand a a charity auction. Would like to see a photo of that.

OMG - the auction is happening as I write this ...I am so curious. The decision was to allow the auction of the mural, but until the case is settled, the new owner can't take possession.
Bluebirdmariposa, Marion, Hannah and Jean, thanks for your comments.

Jean, I donate giclees to many auctions, but I think you are remembering "It's All That", of the Flatirons with poppies and lupines. It is on my website. It went for $5,000 (it was embellished).
